Terms of Service
These terms govern your use of nanimail, a custom-domain email service. By creating an account or using the service, you accept these terms.
1. Who we are
nanimail is a custom-domain email service, operated from Colombia (hereinafter "nanimail", "we"). You can reach us at [email protected].
2. The service
nanimail lets you connect your own domain, create mailboxes, and send and receive email from the browser. The available features and limits depend on the plan you subscribe to.
nanimail is a custodial email service: we manage the keys that encrypt your data at rest, which is what lets us offer account recovery, search, and spam filtering. It is not an end-to-end encrypted service. See our Privacy Policy for details.
3. Your account
To use nanimail you must create an account and provide accurate information. You are responsible for the activity that occurs under your account and for keeping access to it secure. You must notify us if you detect unauthorized use.
You must be of legal age and have the capacity to enter into contracts. nanimail is a service directed at businesses and their professional activity.
4. Acceptable use
You agree not to use nanimail to:
- Send spam, unsolicited bulk email, or any communication that violates anti-spam laws.
- Send unlawful, fraudulent, misleading, defamatory content, or content that infringes third-party rights.
- Distribute malware or attempt to breach the security of the service or of third parties.
- Impersonate other people or organizations.
- Resell the service without our authorization.
Email depends on sending reputation. To protect the deliverability of the whole platform, we apply sending limits and may suspend or restrict sending from an account that generates high bounce or spam-complaint rates, or that breaches this acceptable use.
5. Plans, prices, and payments
Plans and their prices are shown on our Pricing page, in Colombian pesos with tax included. Billing is monthly unless stated otherwise.
When we enable payments, they will be processed by our payment provider (Paddle), acting as merchant of record. By subscribing to a paid plan, you authorize the corresponding recurring charges until you cancel.
You can cancel your subscription at any time; cancellation takes effect at the end of the period already paid. The rights that Colombian law (including the Consumer Statute, Law 1480 of 2011) grants you as a consumer are not affected by these terms.
6. Refunds
Subscriptions are paid in advance. As noted above, you can cancel at any time and cancellation takes effect at the end of the period already paid, stopping future charges. As a general rule we do not issue prorated refunds for the current period, except where applicable law requires it.
If you subscribe as a consumer, you may have a right of withdrawal (derecho de retracto) under the Consumer Statute (Law 1480 of 2011): where it applies, you have five (5) business days to exercise it. Note that this right may not apply to digital services whose delivery begins immediately with your express consent.
To request a refund or exercise your right of withdrawal, write to us at [email protected]. Refunds we approve are processed by Paddle, in its capacity as merchant of record, to the same payment method used for the purchase.
7. Your content
Your emails and files are yours. You grant us only the permissions necessary to operate the service (for example, to store, encrypt, transmit, and display your content). We claim no ownership over it.
8. Availability
We work to keep the service available and functioning correctly, but we do not guarantee it will be uninterrupted or error-free. We may perform maintenance and updates. nanimail is under active development and some features may change.
9. Suspension and termination
We may suspend or terminate your access if you breach these terms, if your use endangers the security or deliverability of the platform, or if required by law. You may stop using the service and close your account at any time.
10. Limitation of liability
To the extent permitted by law, nanimail will not be liable for indirect or incidental damages or lost profits arising from the use of, or inability to use, the service. Nothing in these terms limits liabilities that cannot be legally excluded, including those arising under the Consumer Statute.
11. Changes to these terms
We may update these terms. When we do, we will change the "last updated" date and, if the change is significant, we will aim to notify you through the service. Continued use of the service implies acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Colombia.
